Kevin Mintzer

Since 1999, Kevin Mintzer has represented employees in discrimination, retaliation, sexual harassment, and sexual assault matters, as well as individuals in contractual and other compensation disputes. He also regularly advises employees and executives concerning covenants-not-to-compete, employment contracts, and severance agreements.

Mr. Mintzer has litigated many closely watched employment and sexual assault cases. While a partner at his prior firm, he served as co-lead counsel for a senior business and marketing executive of the New York Knicks in her sexual harassment and retaliation trial against Madison Square Garden, which resulted in an $11.6 million verdict — then the largest ever reported in a single-plaintiff sexual harassment case in New York. More recently, he has represented survivors of Harvey Weinstein and Jeffrey Epstein, including a well-known actor in her claims against CAA, Disney, and Miramax, in which the Appellate Division, First Department recognized that a talent agency may owe a “special relationship” to its clients, and a former fashion model whose Adult Survivors Act claims against Weinstein’s employers survived dismissal in a decision that was the first of its kind. He also served as co-counsel for the executive assistant whose sexual harassment complaint contributed to the resignation of former Governor Andrew Cuomo.

Before founding his own firm in 2008, Mr. Mintzer was a partner at a boutique plaintiff-side employment law firm in New York and a litigation associate at a leading global firm. Early in his career, he was a law clerk for the late Honorable Charles P. Sifton, then Chief Judge of the United States District Court for the Eastern District of New York, and then an appellate law clerk for the Honorable Robert E. Cowen of the United States Court of Appeals for the Third Circuit.

Mr. Mintzer received his law degree from the New York University School of Law, where he was an editor of the New York University Law Review. He received a B.A. in political science from The Johns Hopkins University.

Mr. Mintzer regularly speaks on employment law and litigation topics to attorneys and other legal professionals, including at forums sponsored by the National Employment Lawyers Association (NELA), the New York City Bar, and the New York County Lawyers’ Association. He has served on the New York City Bar’s Committees on Professional Responsibility and Legal Issues Affecting People with Disabilities, and is an active member of NELA’s New York chapter, currently serving as the organization’s nominee to the Manhattan County Democrats 2026 Supreme Court Independent Judicial Screening Panel.

Mr. Mintzer is admitted to practice before the courts of New York State, the United States Supreme Court, the United States Courts of Appeals for the Second and Third Circuits, and the United States District Courts for the Southern and Eastern Districts of New York.

He and his wife live in Manhattan and on the North Fork of Long Island, and have two adult daughters.
